The agreement
These Terms of Service (the "Terms") are a contract between you and Evgenii Zakharov (Անհատ ձեռնարկատեր Եվգենի Զախարով Սերգեյի), an individual entrepreneur registered in the Republic of Armenia under state registration number 286.1480564, taxpayer identification number 40325938 ("we", "us"). We operate Tuned at tunedhq.io, app.tunedhq.io and api.tunedhq.io (the "Service").
The Terms apply together with the Privacy Policy, the Terms of Sale for paid plans and the Refund Policy. If they conflict on payments, the Terms of Sale prevail.
You accept the Terms when you create an account or sign in and confirm acceptance on the sign-in screen. If you do not agree, do not use the Service.
Who can use Tuned
You must be at least 16 years old. If you are under 18, or under the age of majority where you live, you may buy a paid plan only with the consent of a parent or guardian.
You use the Service for your own job search. If you prepare documents for someone else, for example as a career coach, you confirm that the person has authorised you and that you have a lawful basis to give us their data.
You may not use the Service if you are barred from receiving it under the laws that apply to you or to us, including sanctions laws.
Your account
You sign in with a one-time code sent to your email or through a third-party sign-in provider. There is no password: whoever controls your mailbox or provider account controls your Tuned account, so keep them secure.
- One account belongs to one person. Do not share it.
- Do not create several accounts to get more free allowance.
- Tell us at support@tunedhq.io if you think someone else has accessed your account.
You are responsible for activity in your account unless it results from our failure to protect it.
What the Service does
Tuned stores your complete base resume and builds tailored versions of it for specific job postings, drafts cover letters, checks the quality and layout of resumes and exports documents. Some features use AI models provided by third parties, listed on the Subprocessors page.
The Service is provided online. You get access to it; no copy of the software is transferred to you and no licence to the software is granted beyond using the Service as described here.
Free and paid plans differ in the monthly allowance and limits shown on the pricing page. We improve the Service continuously and may add, change or remove features. We will not reduce what you already paid for during a paid period; if a change materially reduces a paid plan, the Terms of Sale explain your options.
Features marked as beta or preview are provided as they are and may change or end at any time.
Your content
Resumes, job postings, notes, files and other material you put into Tuned ("Your Content") remain yours. So does the output generated from Your Content, to the extent any rights exist in it.
You give us a non-exclusive, worldwide, royalty-free licence to host, copy, process, transmit and display Your Content only as needed to provide, secure and support the Service for you, including sending it to the AI providers listed on the Subprocessors page. The licence also covers evaluating the quality of the Service with pseudonymised samples as described in the Privacy Policy, unless you turn this off in your account. We do not use Your Content to train AI models, and we do not sell it.
The licence ends when you delete the content or your account, except for copies kept in backups for the limited time stated in the Privacy Policy and data we must keep by law.
You confirm that you have the right to use Your Content and that it does not infringe anyone else's rights. If Your Content includes information about other people, such as referees, you are responsible for having a lawful basis to share it.
Do not put more sensitive information into a resume than the job requires, such as health data, religion or political views. If you do, you choose to have it processed for the Service.
AI output and your responsibility
The truth of your resume is your responsibility. Tuned builds tailored versions only from what is in your base and checks every edit against it, but it cannot verify that your base is true. You must not use the Service to create documents that misrepresent your qualifications, experience, education or identity.
AI output may be inaccurate, incomplete or unsuitable, and our checks reduce errors but do not eliminate them. Review every document before you send it. You decide what you send to an employer and you are responsible for it.
We do not promise results. Tuned does not guarantee interviews, job offers, passing any applicant tracking system or any particular response from an employer. Match scores and quality checks describe a document; they do not predict hiring decisions.
Other users may receive similar output, because the same models and templates work for everyone. Similar wording does not give either of you rights against the other.
Acceptable use
You agree not to:
- use the Service for anything unlawful, fraudulent or deceptive, including forged credentials or impersonating another person;
- upload content you have no right to use, or other people's personal data without a lawful basis;
- upload malware or content designed to manipulate the AI models or our checks;
- access the Service by automated means other than the interfaces we provide, scrape it, or bypass quotas, rate limits or security measures;
- copy, reverse engineer or resell the Service, or use it to build a competing product;
- place an unreasonable load on the Service or interfere with other users.
Third-party services
Sign-in providers (Google, LinkedIn, GitHub) and payment providers are run by third parties under their own terms and privacy policies. We are not responsible for their services, and their availability may change.
Paid plans
Paid plans, prices, renewals and cancellation are governed by the Terms of Sale. Card payments outside Russia are processed by Polar Software, Inc., our reseller and merchant of record. Refunds follow the Refund Policy.
Our rights
The Service, including its software, design, templates, texts and the Tuned name and mark, belongs to us or our licensors. These Terms do not transfer any of it to you.
If you send us ideas or feedback, we may use them without obligation to you.
Suspension and termination
You may stop using the Service at any time and delete your account under "Account" in the account menu, or ask us to do it at privacy@tunedhq.io. Deleting an account immediately cancels a renewing subscription paid through Polar, and the rest of the paid period is lost; if the cancellation does not go through, the account is not deleted. Before deleting, you can download your data there as well.
We may suspend or close your account if you materially breach these Terms, if the law requires it, if your use creates a security risk or harms other users, or in the case of fraud or an unjustified chargeback. Where reasonable, we will tell you first and give you a chance to fix the problem.
If we close your account without a breach on your part, or stop providing the Service, we will refund the unused part of any prepaid period and give you at least 30 days to export your documents, unless the law or a security threat prevents it.
Availability
We work to keep the Service available and your data safe, but we do not guarantee uninterrupted or error-free operation. Maintenance, provider outages and events outside our control may interrupt it.
Tuned is not an archive. Download copies of documents you need to keep.
Disclaimers and liability
Except as expressly stated in these Terms, the Service is provided "as is" and "as available", without warranties of fitness for a particular purpose, of results or of uninterrupted operation, to the extent the law allows.
To the extent the law allows, we are not liable for indirect or consequential losses, lost profits or earnings, lost job opportunities, or loss of data you could have kept by exporting it.
To the extent the law allows, our total liability for all claims relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim arose and USD 50.
None of this limits liability for intentional misconduct or gross negligence, for death or personal injury, or any other liability that cannot be limited by law, and it does not affect the rights you have as a consumer under mandatory law.
Claims about your content
If a third party makes a claim against us because of Your Content or your breach of these Terms, you will compensate us for the resulting reasonable losses and costs, to the extent the law allows and to the extent the claim is caused by you.
Changes to these Terms
We may update these Terms. For material changes we will notify you by email or in the Service at least 14 days before they take effect, unless a change is required by law sooner. Changes that are unfavourable to you do not apply to a paid period that has already started.
If you do not agree with the new Terms, stop using the Service before they take effect and, if you wish, ask us to delete your account. If you keep using it, the new Terms apply.
Governing law and disputes
These Terms are governed by the law of the Republic of Armenia. Before going to court, please write to support@tunedhq.io describing the issue; we reply within 10 business days and try to resolve it within 30 days.
Disputes are resolved by the competent courts of the Republic of Armenia. If you are a consumer, you also keep the protection of the mandatory law of the country where you live and the right to bring a claim in its courts, where that law gives you this right.
General
If any provision is found invalid, the rest of the Terms remain in force. Not enforcing a provision is not a waiver of it.
We may transfer our rights and obligations under these Terms to a company that takes over the Service, for example a company we set up to run it, if your rights are not reduced. We will tell you in advance. You may not transfer your account without our consent.
These Terms are published in English and Russian. If you accepted them in the Russian version, the Russian text prevails; otherwise the English text prevails.
