Terms of Sale

1.General provisions

This document is a public offer by Evgenii Zakharov (Անհատ ձեռնարկատեր Եվգենի Զախարով Սերգեյի), individual entrepreneur registered in the Republic of Armenia, state registration number 286.1480564, TIN 40325938 ("we"), addressed to any person who wants to buy paid access to Tuned ("you").

You accept the offer fully and without reservations by paying for a paid plan. The contract is concluded at the moment the payment is successfully completed. The Terms of Service, the Privacy Policy and the Refund Policy form part of the contract.

The Terms of Service govern the use of the Service on every plan; this offer adds what concerns payment.

2.Definitions

• Service — the online service Tuned at tunedhq.io and app.tunedhq.io.
• Plan — a form of paid access: Pro, Sprint, Credits or Lifetime.
• Access period — the time during which paid features of a plan are available.
• Quota — the number of operations of a given kind available in a period (tailored resumes, cover letters, base improvements, imports).
• Tailoring — one run that builds a version of your base resume for one job posting.
• Merchant of record — Polar Software, Inc. (USA), which sells access to the Service as our reseller when you pay with a card outside Russia.
• Russian payment service — the third-party payment service named on the checkout page that accepts Russian bank cards on our behalf.

3.Subject of the contract

We provide you with remote access to the features of the Service in online mode, in the scope of the chosen plan and for its access period. This is a service related to software provided in online mode.

The contract is not a licence agreement. No copy of the software, source code or exclusive right is transferred to you; you use the Service as it runs on our infrastructure.

4.Plans and prices

Pro gives a monthly allowance measured in tailored resumes: up to 70 a month. Other paid actions draw on the same allowance: 2 base improvements, 5 edits in words or 10 cover letters cost as much as one tailored resume. Imports are limited separately: 60 a month. The unused allowance does not carry over to the next month. Current prices and the allowance are shown on the pricing page; the price and allowance in effect at the moment of payment apply to that payment.

For payments through Polar, taxes are calculated by Polar based on your location: in countries where the law requires it (for example, in the EU and the UK) the price includes tax, in others tax may be added at checkout. The final amount is shown before you pay.

For payments with Russian cards, the price is in rubles. The payment service or your bank may charge its own fee or convert currency; the amount is shown on the payment page before you pay.

5.Payment

Cards outside Russia. Our order process is conducted by our online reseller Polar Software, Inc., 3500 South DuPont Highway, Dover, DE 19901, USA. Polar is the merchant of record for these orders: the contract of sale is concluded between you and Polar under the Polar Buyer Terms, and Polar handles payment, taxes, invoices and payment-related enquiries. We provide the Service to you under this offer and the Terms of Service.

Russian bank cards. The contract is concluded directly with us. Payment is accepted by the Russian payment service named on the checkout page, which acts on our behalf and under its own terms. We do not receive or store your card details.

Paid access is activated automatically after the payment provider confirms the payment, usually within a few minutes.

6.Renewal and cancellation

Pro paid through Polar is a subscription. It renews automatically every month and Polar charges the price of the plan to the same payment method until you cancel. You can cancel at any time in the billing section of your account, in the Polar customer portal linked from Polar's receipt email or by writing to support@tunedhq.io. Cancellation takes effect at the end of the current period: access stays until then, and no further charges are made.

Deleting your account cancels the subscription immediately rather than at the end of the period: the account and its access are gone, and the rest of the paid period is not refunded under this section (the Refund Policy and statutory rights still apply). If the cancellation does not go through, the account is not deleted.

Pro paid with a Russian card is also a subscription. The payment service named on the checkout page charges the price of the plan to the same card every month until you cancel. You can cancel at any time in the billing section of your account, in your account with that payment service, or by writing to support@tunedhq.io. Cancellation takes effect at the end of the current period: access stays until then, and no further charges are made.

If a renewal payment fails, the payment provider may retry it. Paid features may be suspended until the payment succeeds or the subscription ends.

If we change the price of a subscription, we will notify you at least 30 days before the change applies to your next renewal, so you can cancel beforehand.

Sprint, Credits and Lifetime are one-time payments. They do not renew, there is nothing to cancel, and when the access period ends the account returns to the Free plan. Your documents stay in the account.

Lifetime gives Pro features and monthly allowance for as long as we operate the Service; it is tied to one account and cannot be transferred. If we stop operating the Service, the Terms of Service describe the notice and export period.

7.Immediate start of the service

By paying, you ask us to start providing the Service immediately, before any statutory withdrawal period has ended. If you are a consumer with a statutory right of withdrawal (for example, in the EU, the EEA or the UK), you acknowledge that if you withdraw you may have to pay for the part of the service already provided, and that the right ends once the service has been fully provided. Our Refund Policy gives a refund on its own terms in addition to these rights.

8.Provision of the service

The service is provided continuously during the access period, from the moment paid access is activated. No acceptance certificates are signed: the records of the Service about access being activated and used, together with the payment records of the payment provider, confirm that the service was provided.

If paid features are unavailable to you through our fault, write to support: we will restore access and extend the period by the time lost or refund that part of the payment.

9.Refunds

Refunds are made under the Refund Policy, which forms part of this offer: in short, the first payment for a plan is refunded within 14 days if after the payment no more than 5 tailored resumes' worth of the allowance has been spent. Rights you have under mandatory consumer law apply in addition.

10.Obligations of the parties

We undertake to provide access to the paid features in the scope of the plan, to keep the allowance and limits stated at the moment of payment during the paid period, and to answer enquiries sent to support.

You undertake to pay for the plan, to use the Service in line with the Terms of Service and to keep your account secure.

11.Liability

Liability of the parties is governed by the Terms of Service, including the limitation of liability, which does not affect your rights as a consumer under mandatory law.

Neither party is liable for failure to perform caused by circumstances beyond its reasonable control, such as outages of internet or infrastructure providers, blocking of services by public authorities, sanctions, acts of state bodies, natural disasters or armed conflicts, for as long as those circumstances last. We will tell you about such circumstances and, if they last more than 30 days, refund the unused part of the paid period on request.

12.Term of the contract

The contract is in force until the end of the paid access period, and for a subscription until it is cancelled and the current period ends. Obligations relating to refunds, liability and disputes survive the end of the contract.

13.Changes to the offer

We may change this offer by publishing a new version on this page. The version in effect at the moment of payment applies to that payment. Changes to renewing subscriptions follow the notice rules in the Terms of Service and in the renewal section above.

14.Governing law and disputes

The contract is governed by the law of the Republic of Armenia. Before going to court, send a claim to support@tunedhq.io: we reply within 10 business days. Disputes are resolved by the competent courts of the Republic of Armenia; if you are a consumer, you keep the protection of the mandatory law of the country where you live and the right to bring a claim in its courts where that law provides it.

This offer is published in English and Russian. For payments made on the Russian version of the site or with Russian bank cards, the Russian text prevails; otherwise the English text prevails.
